Your Privacy is Important to Us

This Privacy Notice describes our policies and practices relating to the information we collect when you access or use our websites, products, applications or online, cloud-based or mobile services or when you otherwise interact with us and sets forth your privacy rights. This Privacy Notice reflects our fundamental respect for your right to privacy and will serve to guide our relationship with you. We take privacy, security and complying with data protection and privacy laws seriously.

Updates

We recognize that information privacy is an ongoing responsibility, and from time to time we will update this Privacy Notice as we undertake new personal information practices or adopt new privacy practices. Any changes to this Privacy Notice will be placed here and will supersede this version. If we make changes to this Privacy Notice, we will revise the “Last Updated” date above and, in some cases, we may provide you with more prominent notice (such as by sending you a notification or providing notice through the Products and Services). However, to be on the safe side, we encourage you to: (1) review this Privacy Notice whenever you access the Products and Services to stay informed about our information practices and to ensure that our practices continue to meet your approval; and (2) view privacy terms specific to Q-SYS Reflect Enterprise Manager below.

By visiting our website, using our Products and Services otherwise interacting with us in any manner, you are a user (“User”). As a User, you acknowledge that we collect, use, disclose and process your personal information pursuant to the terms set out herein and for the purposes established in this Privacy Notice.

Children

QSC’s Services are not intended for or directed at children under the age of 18. In addition, QSC does not knowingly collect information from children under the age of 18. Children under the age of 18 should not use this website or engage QSC’s Services.

These additional disclosures are required under the California Privacy Rights Act by certain state privacy laws, and provide a Notice at Collection under the California Privacy Rights Act:

1. Categories of personal information collected. The personal information that QSC collects or has collected from consumers in the twelve months prior to the effective date above, fall into the categories described in the What Information Do We Collect About You? section of this Privacy Notice.
2. Categories of personal information disclosed for a business purpose. The personal information that QSC may have disclosed for a business purpose to the third parties identified in the "What Information Do We Share About You?" section of this Privacy Notice in the twelve months prior to the effective date above fall into the categories described in the What Information Do We Collect About You? section of this Privacy Notice.
3. Advertising. As explained in the "Advertising and Analytics Services Provided by Others" section in this Privacy Notice, QSC shares and processes personal information for the purposes of targeted advertising as that term is defined under certain state privacy laws. Any personal information QSC may have shared for the purpose of cross-context behavioural advertising, as that term is defined by the California Privacy Rights Act, in the twelve months prior to the effective date above falls into the following categories:
   • identifiers such as a cookie, a device identifier, or a code derived from applying irreversible cryptography to other information like an email address; we do not share your name or other information that directly identifies you with ad companies.
   • internet or other electronic network activity information, such as whether you downloaded an app or other measures of ad effectiveness; for example, if you have already downloaded one of our apps, we will share an advertising identifier and data about that event so that you will not be served an ad to download the app again.
   • inference data; while we do not share your specific shopping actions like purchases, product views, or searches with ad companies, we may share an advertising identifier and an estimate of the value of the ads they show you on our behalf so they can serve you with more effective QSC ads.

The categories of third parties with whom QSC may share personal information for the purpose of cross-context behavioural advertising are identified in the “What information do we share about you?” and "Advertising and Analytics Services Provided by Others" sections of this Privacy Notice.

1. Children and Teens. As stated in this Privacy Notice QSC does not allow individuals under the age of 18 to use this website or QSC Services.
2. No sale of personal information. In the twelve months prior to the effective date of this disclosure, QSC has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.
3. De-identified Data Disclosure. QSC may use de-identified data in some instances. QSC either maintains such data without attempting to re-identify it or treats such data as personal information subject to applicable law.
4. California Privacy Rights Act Sensitive Personal Information Disclosure. The categories of data that QSC collects and discloses for a business purpose include "sensitive personal information" as defined under the California Privacy Rights Act. QSC does not use or disclose sensitive personal information for any purpose not expressly permitted by the California Privacy Rights Act.
5. California Privacy Rights Act Retention Disclosure. We retain your personal information as set forth in the How Long Do We Retain Your Personal Information? section of this Privacy Notice.
6. California Privacy Rights Act Non-discrimination Statement. QSC will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.
7. Colorado Privacy Act and Oregon Consumer Privacy Act Profiling Disclosure. QSC does not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act or the Oregon Consumer Privacy Act.
8. Oregon Consumer Privacy Act Controller Entity Disclosure. The controller entities that are subject to this Privacy Notice and this Disclosure include QSC, LLC.
9. Consumer Privacy Rights. You have certain choices regarding our use and disclosure of personal information about you, as described below. To exercise any of these rights please email our team at privacy@qsc.com.
   • Access: You have the right to request, twice in a 12-month period, that we disclose to you the personal information related to you we have collected during the past 12 months. This may include:
     • The categories and specific pieces of personal information we have collected about you
     • The categories of sources from which we collected the personal information
     • The business or commercial purpose for which we collected or sold the personal information
     • The categories of third parties with whom we shared the personal information
     • The categories of personal information about you that we sold or disclosed for a business purpose, and the categories of third parties to whom we sold or disclosed that information for a business purpose
   • Correction: You have the right to request that we correct certain personal information we have collected, considering the nature of the personal information and the purposes of the processing of the personal information. If you make a correction request, we may correct or instead delete information as allowed by law.
   • Deletion: You have the right to request that we delete certain personal information we have collected from you.
   • Opt-Out of Sharing: You have the right to opt-out of the sharing of your personal information for cross-context behavioural advertising (i.e., targeted advertising).
   • Limit use of Sensitive Information: You have the right to limit the use and disclosure of sensitive information collected about you.
   • Opt-Out of Sale: You have the right to opt-out of the sale of personal information about you.
   • Object to use of AI Tools: You have the right to object to the use of AI Tools with your personal information where the use of such AI Tools with your personal information impacts your rights or otherwise has a significant effect on you.
10. Appeals. You may have the right to appeal the denial of any of these rights by submitting a form that will be provided to you if we deny a data request. Depending on your data choices, certain services may be limited or unavailable.
11. Reports. You may request information on the number and processing of the following types of requests to QSC by delivering the request via privacy@qsc.com: Access Requests; Deletion Requests; Opt-Out of Sharing Requests; Limitation on Use Requests; Objections to the use of AI Tools; and Correction Requests.

The terms in this section (“Q-SYS Reflect Privacy Terms”) apply SOLELY to your use of the QSC Q-SYS Reflect Enterprise Manager Service (the “Subscription Services”) as a User of QSC (QSC, LLC and our affiliates), including the use of our associated applications. Terms not otherwise defined herein shall have the meaning as set forth in the Master Subscription Agreement (the “Agreement”).

These Privacy Terms apply when QSC processes personal information received from or generated by a User on behalf of such User, including without limitation data from devices connected to or monitored using the Subscription Services, as a processor in the course of providing Subscription Services to the User pursuant to the Agreement. These terms do not apply to any information or data collected by QSC as a controller for other purposes, such as information collected on our websites or through other channels for marketing purposes. That information or data is covered by the privacy terms in the above sections of this Privacy Notice.

QSC processes personal information under the direction of our User and has no direct control or ownership of the personal information we process. Users are responsible and liable for complying with any regulations or laws applicable to transferring the data to QSC for processing purposes.

At times, QSC may process, for its own purposes and independent from the User, for the purposes specified in Section 1 below, personal information which has been disclosed to it by the User during QSC providing the Subscription Service to the User or that is generated by or related to User’s usage of the Subscription Services. This includes, but is not limited to, data and information from Q-SYS Cores and Q-SYS and third party peripherals connected to, monitored, or managed, using the Subscription Services such as: system and peripheral logs such as syslogs and event and licensing logs; operating system metrics such as CPU load and memory and file system usage; design summary information such as an inventory of connected devices and software components and plugins used; and device and sensor telemetry such as temperatures, fans speeds, ethernet statistics, and loading conditions. QSC may indirectly collect through our customers’ information regarding our end Users, which includes, without limitation, navigational data, email data, system usage data, application integration data, contact information, and other electronic data submitted, stored, sent or received by such Users.

In the event of a conflict between the Q-SYS Reflect Privacy Terms and the Agreement (including any Data Protection Addendum between the parties) the terms of the Agreement will control.

We periodically update the Q-SYS Reflect Privacy Terms. We will post any changes on this page and, if the changes are significant, we will provide an update through the portal and other appropriate means. While we will notify you of any material changes to the Q-SYS Reflect Privacy Terms prior to the changes’ becoming effective, we encourage you to review these terms periodically. We will also keep prior versions of the Q-SYS Reflect Privacy Terms in an archive for your review.

1. Use of the Subscription Services

The Q-SYS Reflect Subscription Services

The information added to the Subscription Services, either by site visitors providing their contact information or when a Subscription Services user adds the information, is stored and managed on our service providers’ servers. QSC provides the Subscription Services to Users directly and through authorized third-party channels.

Use by QSC

We use the information collected through our Subscription Services by our Users and other data and information related to customer or User use of the Subscription Services, including from connected or monitored devices, for the following purposes: to provide the Subscription Services (which may include, among other things, the detection, prevention and resolution of security and technical issues); to respond to customer support requests; to evaluate interest in, and to develop, enhance, improve, and analyze the performance and/or condition of our products and services; to examine and understand trends, to better market and advertise our products and services; to troubleshoot and localize our products and services; and otherwise to fulfill the obligations under the Agreement. Information that we collect and manage using the Subscription Services for our own marketing belongs to us and is used, disclosed and protected according to this Privacy Notice.

Use of Third Parties

When Users authorize a third party to access the Subscription Services on their behalf, those parties may collect User information. QSC has no control over the collection, storage, or use of information by these third party providers and is not responsible for their data handling practices or compliance with applicable privacy laws. Use of third party services is subject to each provider’s privacy notice, and QSC encourages Users to review these notices carefully.

2. Data Subject Requests

If you are a User, prospect, or otherwise interact with one of our User and would no longer like to be contacted by one of our User that use our Subscription Services, please contact the User with which you directly interact. If you want to access, correct, amend, or delete data controlled by a QSC User, you should direct your query to the User (the data controller).

You may request the deletion of your QSC account or Subscription Services by sending a request to privacy@QSC.com.

3. Data Retention

The data the User collects as part of its use of the Subscription Services is retained according to the relevant agreements between the User and QSC. Personal information is retained for at least as long as the User remains active. Customer data is deleted upon the User’s written request or after an established period following the termination of all customer agreements. Personal information may be deleted after a User’s paid subscription ends.
